Tonkon Torp L&E Coffee Break Looks at the ADA and COVID-19

The Coffee Break webinar series, hosted by attorneys in Tonkon Torp’s Labor & Employment Practice Group, provides practical advice to help businesses navigate L&E issues related to reopening their business. The May 21 session, featuring partners Bob Carey and Haley Morrison, explored the Americans with Disabilities Act (ADA) as it relates to COVID-19.
Among other things, Haley spoke about the interaction with other federal and state leave laws, and the importance of the interactive process. She also walked through particular COVID implications, including the EEOC’s revised guidance for disability-related inquiries and medical exams during the pandemic.
Bob explained COVID-related accommodation needs that the L&E group is currently seeing, or expecting to see in the near term, including a spike in mental health issues. He also discussed challenges with the “old” accommodation model, including declining work-from-home requests, given that many employees are successfully working remotely during the pandemic.
